Quality prosecution is too often viewed solely within the four corners of a patent application. While great care should be given to the drafting of the application and pursuing its issuance, we believe that such care is only part of developing quality patents.
At Muir Patent Consulting, PLLC, we take a broader approach and first assess our client’s goals in strengthening a patent portfolio. Some of these goals may include:
- Preparation for cross license negotiations
- Obtaining a bargaining chip for entering a new market
- Exclusion of competitors from market
- Company valuation and/or funding procurement
- Revenue generation from licensing fees
- Avoiding wholesale copying of product
- Marketing
Once the client’s goals are understood, we may then target technologies for invention harvesting. Applications may be written and claims drafted with a focus on these goals. Where the client’s objectives are not met by their current R&D, the portfolio may be expanded through patent purchasing and/or invention creation.
After the application and claims are drafted, we continue to focus on the client’s objectives with careful prosecution of the application to issuance. Located minutes from the U.S. Patent and Trademark Office, we recommend conducting personal interviews with Examiners for most applications. We also suggest continuing to perform a regular review of the application(s) in view of possible changes in client objectives and industry development.
